Rental Terms
All vehicle rentals are governed by a comprehensive Rental Agreement, which will be provided during booking confirmation or at the time of vehicle collection. This agreement outlines the specific terms, conditions, insurance information, associated charges, and your obligations for the rental. In case of any discrepancies between these Terms and the Rental Agreement, the Rental Agreement will prevail.
Eligibility Criteria
Renting a vehicle with us requires:
- To rent a vehicle from Witham Car Hire, you must be at least 21 years old, though age requirements may differ based on the vehicle type. A valid driving licence, suitable for the vehicle category, is required and must be held for the duration outlined in the Rental Agreement. You will need to present valid identification and proof of your current address, along with payment information and a security deposit. Additional requirements may be specified in the Rental Agreement.
Booking and Payment Details
- Reservations can be arranged via our website, by phone, or directly at our Witham office. A deposit may be necessary to confirm your booking. The total payment, along with a security deposit, is generally required upon vehicle pickup. All prices are listed in British Pounds (£) and include VAT where relevant. We accept major credit and debit cards, processed securely through trusted payment platforms.
Vehicle Pickup and Drop-off
- Upon collecting your vehicle, it is important to conduct a thorough inspection and report any pre-existing damage without delay. A vehicle condition report will be created and signed by both parties. Please return the vehicle in the same condition as it was received, accounting for normal wear and tear. Any new damage will be evaluated and may result in additional charges. Make sure to return the vehicle with the same fuel level as at collection; refueling fees will apply if the fuel level is lower. Late returns could incur extra charges, so please inform us promptly if you expect to return the vehicle late. You are responsible for any parking tickets, traffic violations, or related charges that occur during the rental period, along with an associated administration fee.
5. Coverage and Responsibility
- All rentals come with basic third-party insurance included. For comprehensive coverage details and excess amounts, please refer to the Rental Agreement. Additional insurance options may be offered to minimize your financial exposure. It is advisable to review these options thoroughly. You remain liable for any damages or losses up to the insurance excess, unless further coverage is secured. Any damage resulting from negligence, misuse, or violation of these Terms falls under your responsibility, irrespective of insurance provisions.
6. Modifications and Cancellations
Cancellation and amendment policies depend on the type of booking and the notice period provided. For precise information, consult your booking confirmation or Rental Agreement. Please be aware that late cancellations or no-shows could incur additional charges.
7. Restricted Activities
Prohibited Vehicle Uses
- Use of the vehicle for illegal activities is prohibited. Engaging in racing, rallying, off-roading, or similar dangerous practices is not permitted. Transporting hazardous materials is strictly forbidden. Sub-letting the vehicle or allowing unauthorized drivers is not allowed. Driving under the influence of alcohol or drugs is unacceptable. Do not exceed passenger or weight limits, and avoid driving outside designated geographical areas without permission.
Breach of these terms may lead to rental termination and extra fees.
Liability Limitations
To the fullest extent allowed by English and Welsh law, Witham Car Hire will not be responsible for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business, resulting from your use of our services. Our total liability for any claims will not exceed the total amount you paid for your rental in the previous 12 months. This limitation does not apply to liability for death or personal injury due to negligence or fraud.
9. Applicable Law
These Terms are governed by the laws of England and Wales. Disputes will fall under the exclusive jurisdiction of the courts in this region.
10. Updates to Terms
We reserve the right to update these Terms at any time. Changes take effect immediately upon being posted on our website. Continued use of our services indicates your acceptance of the revised Terms.
